KZN EFF chairperson Twala will stay in custody for another night after the magistrate stepped down from the case.
Mongezi Twala, the EFF's KwaZulu-Natal leader, along with four others, has not yet applied for bail related to charges of public violence and malicious damage to property.
Twala and his co-accused were arrested following a protest that caused damage to infrastructure at the uMhlathuze Local Municipality last week.
The EFF supporters aimed to disrupt a council meeting to demand that three of their six seats be declared vacant.
The group was scheduled to apply for bail, but the hearing was postponed to allow for a new magistrate to take over.
On Monday, the case was moved to Tuesday for the appointment of a new magistrate.
However, when they arrived, Magistrate Vincent Hlatshwayo also had to step down due to a conflict of interest, as one of the accused, Sabelo Khubisa, is an attorney in the same court.
After consulting with the necessary authorities, Hlatshwayo announced that a new magistrate from KwaDukuza would be assigned to the case.
As a result, the five accused will now apply for bail on Wednesday.
